Sharon contacted ABC for Health after her insurance company refused to cover her son’s speech therapy—treatment his doctors determined would help him to regain his ability to speak. Sharon and ABC repeatedly asked the insurance company to provide the documents it used to deny coverage. Several years ago Sharon and ABC took the insurance company to court.
The Seventh Circuit Court of Appeals agreed with ABC that the insurance company was legally obliged to provide the documents it used to deny coverage of her son’s speech therapy. ABC later appealed to the Seventh Circuit, saying that the district court judge erred when calculating the damages and penalties involved. This case affects large numbers of people within the jurisdiction of the Seventh Circuit Court of Appeals.
